These Terms & Conditions ("Terms") govern your access to and use of the Testmoon website (testmoon.co.in) and the Testmoon platform (collectively, the "Service"), operated by Testmoon ("we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility & accounts
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Use of the Service
- You may use the Service only for lawful purposes and in accordance with these Terms.
- You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its operation, reverse-engineering it, or using it to generate tests against systems you do not own or have permission to test.
- You are responsible for the content and inputs you submit and for ensuring you have the rights to do so.
3. Plans, billing & trials
Paid plans are billed in advance on a recurring basis according to the plan you select. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes take effect at your next billing cycle. Free tiers and trials may be offered subject to usage limits and may be modified or withdrawn at any time.
4. Intellectual property
The Service, including its software, design, and branding, is owned by Testmoon and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service. You retain ownership of the content you submit; you grant us a licence to process it solely to provide the Service.
5. AI-generated output
Testmoon uses artificial intelligence to generate test cases and related output. While we strive for quality, AI-generated output may contain errors or omissions and is provided for your review. You are responsible for validating output before relying on it, and Testmoon does not guarantee that generated tests will detect all defects.
6. Third-party services
The Service may integrate with third-party tools (such as version-control and CI/CD providers). Your use of those services is governed by their own terms, and we are not responsible for them.
7. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Testmoon will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising from your use of the Service. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim.
10. Changes to these Terms
We may update these Terms from time to time. We will post the revised version with an updated date, and continued use of the Service constitutes acceptance of the changes.
11. Governing law
These Terms are governed by applicable law in the jurisdiction in which Testmoon operates, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
